UK Dependent Visa

Overview of the UK Dependant Visa

The UK Dependant Visa enables immediate family members of certain UK visa holders to join them in the UK. This option is available to dependants of individuals on various visas, including those for work, study, business, and ancestry. The term 'PBS Dependant Visa' specifically refers to family members of those on point-based system visas, like the Skilled Worker Visa, allowing them to accompany the main visa holder to the UK.

Recent Changes to Dependant Visa Rules

Starting January 2024, new regulations will restrict international students from bringing dependants to the UK, unless enrolled in PhD studies or postgraduate research programs. Furthermore, from 11 March 2024, care workers and senior care workers will also be ineligible to bring dependants to the UK.

Eligibility for a Dependant Visa

Eligibility for a Dependant Visa extends to spouses, partners, or children of individuals holding eligible UK visas. Partners must be married, in a civil partnership, or have cohabited for at least 2 years. Children eligible for a dependant visa must be under 18, or over 16 and financially reliant on the main visa holder, not living independently, and residing with the main visa holder unless studying.

Requirements for a Dependant Visa

Applicants must:

  • Prove their relationship to the main visa holder.
  • Demonstrate financial capability to support themselves in the UK.
  • Confirm their identity and relationship to the visa holder.
  • Intend to live with the sponsor in the UK.

Financial Requirements for Dependants

Financial requirements vary based on the main visa holder's visa type. For example, Skilled Worker Dependant Visa applicants need to show they have:

  • £285 for a partner.
  • £315 for one child and £200 for each additional child. There's generally no financial requirement for dependants who have been in the UK for over a year.

Document Checklist for Dependant Visa Applications

Required documents may include:

  • The main visa holder's Global Web Form (GWF) or Unique Application Number (UAN).
  • Proof of identity, like a passport.
  • Evidence of the relationship, such as marriage or birth certificates.
  • Documentation proving dependency, like evidence of shared residence or financial support.
  • Bank statements showing sufficient funds.

  • Filling out the online form.
  • Help in Paying the application fee.

Visa Validity and Rights

Dependant Visas are usually valid for the same period as the main visa holder's permission. Holders can work, study, and travel freely within the UK but cannot access public funds.

Pathway to Settlement

Dependant visa holders may apply for Indefinite Leave to Remain (ILR) alongside the main visa holder after 5 years of continuous residence in the UK, subject to ongoing relationship and financial support criteria. ILR enables permanent residence in the UK, with the potential for British citizenship after a further year.
