UK Spouse Visa

 

What is a UK Spouse Visa?


A UK Spouse Visa allows a non-UK resident to live in the UK with their partner who is either a British citizen or has permanent residency (like Indefinite Leave to Remain or EU Settled Status). Marrying a British citizen doesn't automatically grant you UK residency. You must apply for a Spouse Visa. This visa is for married couples, civil partners, or those who have been living together for at least two years.


Who Can Apply?


You're eligible for a Spouse Visa if your UK-based partner is:


  • A British or Irish citizen
  • A permanent resident in the UK with Indefinite Leave to Remain, permanent residence, or EU Settled Status
  • A refugee or under humanitarian protection in the UK
  • Holding a Turkish Businessperson or Worker visa


Your intention to live together in the UK must be clear, and you'll need to prove your relationship is genuine.


Requirements for a UK Spouse Visa


To successfully apply for a Spouse Visa, you must:


  • Be in a genuine relationship
  • Have a combined annual income of at least £18,600 (rising to £29,000 in April 2024 and incrementally to £38,700)
  • Have adequate accommodation in the UK
  • Meet the English language requirement, at least level A1 for your initial application


Key Requirements Explained:


  1. Genuine Relationship: You must be legally married or in a civil partnership recognized in the UK, have lived together for at least 2 years, or plan to marry or form a civil partnership within 6 months of arriving in the UK.
  2. Financial Requirement: You and your UK partner need a minimum annual income of £18,600. This will increase to £29,000 in Spring 2024, with further increments planned. Additional funds are needed for children: £3,800 for the first child and £2,400 for each additional child.
  3. English Language Requirement: You can meet this by passing a CEFR English test at level A1 or higher, holding an academic qualification taught in English, or being exempt due to age, medical condition, or nationality.
  4. Accommodation: You need to show you have adequate living arrangements in the UK that meet public health standards.
