UK Fiancé Visa

 

What is a UK Fiancé Visa?


A UK Fiancé Visa allows foreign nationals over 18 to come to the UK to marry or form a civil partnership with a British citizen or someone permanently settled in the UK (like those with Indefinite Leave to Remain or EU Settled Status). This visa falls under the family visa category.


Eligibility and Requirements


To apply for a Fiancé Visa, you must:


  • Both be over 18 years old.
  • Plan to marry or form a civil partnership within 6 months of arriving in the UK.
  • Intend to live together in the UK after your marriage or civil partnership.
  • Have a partner who is a British or Irish citizen, has settled status, refugee status, or humanitarian protection in the UK.
  • Have a combined annual income of at least £18,600 (rising to £29,000 in April 2024 and incrementally to £38,700).
  • Have suitable accommodation in the UK.
  • Meet the English language requirement, typically by passing a level A1 English test.


Financial Requirements


You and your UK-based partner need a minimum income of £18,600 annually. If you have children, you'll need an extra £3,800 for the first child and £2,400 for each additional child. You can use savings to meet part of this requirement, with £62,500 in savings allowing you to meet the financial requirement without needing additional income.


English Language and Accommodation


You must prove your knowledge of English by passing a level A1 test or having an academic qualification taught in English. Your accommodation in the UK should be adequate for living and must meet public health standards.

Duration and Transition to ILR


A Fiancé Visa is valid for 6 months, allowing you to marry or form a civil partnership in the UK. Afterwards, you can apply for a Spouse Visa, which is initially valid for 33 months and can be extended for another 30 months. After 5 years in the UK, you may be eligible for Indefinite Leave to Remain (ILR), granting permanent residency.


Differences Between Fiancé and Spouse Visas


The key difference is that a Fiancé Visa is for those planning to get married or form a civil partnership in the UK, while a Spouse Visa is for those already married or in a civil partnership. A Fiancé Visa is temporary (6 months), whereas a Spouse Visa offers longer residency (up to 33 months initially).
